Terms & Conditions
By reserving, renting, receiving, wearing, or using any Hanfu costume, garment, accessory, headpiece, footwear, prop, or related item (collectively, the "Rental Items"), the customer or renter ("Renter") agrees to the following terms and conditions.
01 Online Reservation and Acceptance of Terms
By checking the box labeled "I have read and agree to the Hanfu Costume Rental Agreement, Liability Waiver, Terms & Conditions" during the online reservation or checkout process, the Renter acknowledges and agrees that:
- The Renter has had the opportunity to read and review these Terms & Conditions before completing the reservation.
- The Renter understands and voluntarily agrees to be legally bound by these Terms & Conditions.
- Checking the acceptance box constitutes the Renter's electronic acceptance of this agreement and is intended to have the same legal effect as a handwritten signature to the extent permitted by applicable law.
- The Renter may not complete the reservation unless the required checkbox is selected.
If the reservation is made on behalf of a minor under 18 years of age, the parent or legal guardian completing the reservation represents that they have the legal authority to accept these terms on behalf of the minor and assumes responsibility as described in this agreement.
02 Rental Period and Return Requirements
All Rental Items must be returned to the designated Hanfu rental location by the return time specified in the reservation, checkout record, rental confirmation, or instructions provided by authorized rental staff.
Unless expressly authorized in writing, all Rental Items must remain on the Moon Festival grounds and may not be taken off-site.
The Renter is responsible for returning every item included with the rental, including, but not limited to, robes, skirts, tops, sashes, belts, hairpieces, jewelry, fans, accessories, footwear, and props.
Late returns may be subject to additional fees. Rental Items not returned by the required deadline may be considered lost, and the Renter may be charged the full replacement value in addition to any applicable late fees or other charges.
03 Rental Pickup and Return Times
Rental pickup is available between 4:00 PM and 6:00 PM on the Renter's scheduled rental date. Renters must arrive within this designated pickup window to receive their reserved Hanfu costume and accessories.
All Rental Items must be returned no later than 9:00 PM on the same day of the rental. The Renter is responsible for returning all costumes, garments, accessories, headpieces, footwear, props, and other rented items to the designated Hanfu rental location at the Moon Festival by the required return deadline.
Failure to pick up a reservation by 6:00 PM may be considered a no-show, and the reserved costume may be released to another customer unless prior arrangements have been approved by the Rental Provider.
Rental Items returned after 9:00 PM may be subject to late fees. Rental Items that are not returned by the end of the event day may be considered unreturned or lost, and the Renter may be charged additional fees up to the full replacement value of the Rental Items, as permitted under this Agreement.
04 Responsibility for Rental Items
The Renter assumes responsibility for all Rental Items from the moment they are received until they are physically returned to and accepted by authorized rental staff.
The Renter agrees to exercise reasonable care and protect all Rental Items from:
- Loss or theft
- Tears, rips, holes, or burns
- Food or beverage stains
- Makeup, lipstick, foundation, or cosmetic stains
- Paint, ink, oil, wax, or glue
- Excessive dirt, mud, or grass stains
- Water damage, including entering the lake or other bodies of water
- Smoke, fire, or excessive odors
- Unauthorized alterations or repairs
- Any other damage beyond ordinary wear and tear
The Renter may not cut, sew, pin, glue, tape, dye, wash, iron, steam, alter, or attempt to repair any Rental Item without prior written authorization.
05 Damage, Loss, Theft, and Replacement Charges
The Renter is financially responsible for Rental Items that are lost, stolen, destroyed, not returned, or damaged beyond normal wear and tear while in the Renter's possession.
Depending on the nature and severity of the damage, the Renter may be charged for:
- Additional or specialized cleaning
- Professional repair or restoration
- Missing accessories or individual pieces
- The full replacement value of the Rental Item
The Rental Provider reserves the right to reasonably determine whether a Rental Item requires additional cleaning, repair, restoration, or replacement.
If the Renter has provided a valid payment method in connection with the reservation, the Renter authorizes the Rental Provider to charge reasonable and documented amounts owed under this agreement, to the extent permitted by applicable law and the applicable payment processor's rules.
06 Cleaning and Condition
Standard cleaning is included in the rental fee unless otherwise stated. However, excessive staining, soiling, odors, bodily fluids, makeup, food, beverages, mud, paint, ink, oil, wax, or other unusual contamination may result in additional cleaning, repair, or replacement charges.
The Renter must not attempt to wash, dry-clean, iron, steam, bleach, or otherwise clean Rental Items.
07 Security Deposit
If a security deposit is required, it may be held until all Rental Items have been returned and inspected.
Reasonable charges for late returns, missing pieces, excessive cleaning, damage, repair, restoration, or replacement may be deducted from the security deposit where permitted.
If the amount owed exceeds the security deposit, the Renter remains responsible for the outstanding balance.
08 Fit, Comfort, and Personal Responsibility
The Renter is responsible for selecting an appropriate size and determining whether the Rental Items are comfortable and suitable for use.
Hanfu costumes may include long sleeves, flowing skirts, robes, sashes, trains, headpieces, hair accessories, and other elements that may create tripping, entanglement, visibility, heat, or mobility hazards. The Renter agrees to exercise appropriate care while:
- Walking or running
- Using stairs or uneven pathways
- Approaching the lake or water
- Participating in festival activities
- Moving through crowded areas
- Walking on grass, dirt, wet surfaces, or uneven terrain
09 Assumption of Risk and Release of Liability
The Renter understands and voluntarily assumes the ordinary risks associated with wearing and using Rental Items, including, but not limited to, tripping, falling, slipping, restricted movement, overheating, discomfort, allergic reactions, skin irritation, and risks associated with crowds, outdoor terrain, weather, water, and festival activities.
To the fullest extent permitted by Arizona law, the Renter releases and agrees not to hold liable the Rental Provider, Moon Festival organizers, United States Chinese Cultural Federation, Phoenix Food Fair, City of Tempe, and their respective officers, directors, employees, volunteers, contractors, sponsors, agents, affiliates, and representatives for claims arising from the Renter's ordinary use, misuse, or handling of Rental Items, except to the extent caused by gross negligence, willful misconduct, or circumstances in which liability cannot legally be waived.
10 Lake and Water Safety
Because the Moon Festival takes place at Kiwanis Park near a lake, the Renter acknowledges that water and shoreline areas may present additional risks.
Unless expressly authorized as part of an official event activity, the Renter may not enter, wade into, swim in, or intentionally expose Rental Items to the lake or any other body of water.
The Renter assumes responsibility for exercising appropriate caution near the lake, shoreline, docks, wet surfaces, and other water-adjacent areas.
11 Personal Property
The Rental Provider and event organizers are not responsible for personal belongings that are lost, stolen, damaged, misplaced, left in fitting areas, or accidentally returned with Rental Items.
The Renter is responsible for checking all pockets, bags, changing areas, and Rental Items before returning the costume.
12 Children and Minors
Any Renter under 18 years of age must have these Terms & Conditions accepted by a parent or legal guardian.
By completing the online reservation and checking the acceptance box on behalf of a minor, the parent or legal guardian confirms that they have read and agreed to these Terms & Conditions and accepts responsibility for the minor's compliance with them and, to the extent permitted by law, for applicable charges arising from loss of or damage to Rental Items.
Children must be appropriately supervised by a responsible adult while wearing Rental Items.
13 Health, Hygiene, and Allergies
Rental Items may have been previously worn and professionally cleaned or otherwise maintained between rentals.
Individuals with known allergies, skin sensitivities, respiratory sensitivities, or other concerns are responsible for determining whether wearing a Rental Item is appropriate for them.
The Renter should immediately discontinue use of any Rental Item if discomfort, irritation, breathing difficulty, or another adverse reaction occurs and seek appropriate medical attention when necessary.
14 Prohibited Uses and Conduct
Rental Items may not be used for illegal, dangerous, abusive, discriminatory, or intentionally destructive activities.
While wearing Rental Items, Renters may not engage in horseplay, enter restricted areas, swim, wade into the lake, or participate in activities that create an unreasonable risk of personal injury or damage to Rental Items.
Smoking, vaping, exposure to open flames, and participation in activities involving fire while wearing Rental Items are prohibited.
15 Photography and Public Event Notice
The Renter understands that the Moon Festival is a public event where photography and video recording by attendees, news media, photographers, videographers, and members of the public may occur.
The Rental Provider does not guarantee privacy from incidental photography or filming in public areas.
16 Weather and Outdoor Conditions
The Renter understands that the Moon Festival is an outdoor event and that Rental Items may be exposed to heat, wind, dust, grass, dirt, mud, rain, water, and other outdoor conditions.
The Renter agrees to follow reasonable instructions from rental staff regarding the protection or return of Rental Items during severe weather or unsafe conditions.
17 Refusal or Termination of Rental
The Rental Provider reserves the right to refuse or terminate a rental when reasonably necessary because of safety concerns, suspected misuse, violation of these Terms & Conditions, or the need to protect Rental Items.
No refund is guaranteed when a rental is terminated because of the Renter's violation of these terms.
18 Refunds, Cancellations, and No-Shows
Unless otherwise stated in the applicable reservation policy:
- Rental fees become non-refundable once the Renter has received or worn the Rental Items.
- Failure to arrive during the designated reservation or pickup period may be treated as a no-show. The Rental Provider does not guarantee that a specific costume, style, color, or size will remain available if the Renter arrives late.
- Cancellations made within seven (7) calendar days of the event will be subject to a cancellation fee equal to 50% of the total rental fee. The remaining 50% of the rental fee will be refunded to the original method of payment, where applicable.
- Cancellations made within 24 hours of the scheduled rental time, as well as no-shows, are non-refundable and will result in forfeiture of 100% of the rental fee.
19 Costume Availability and Substitutions
Although reasonable efforts will be made to provide the costume, size, style, or color selected during the online reservation process, availability cannot be absolutely guaranteed due to unforeseen damage, late returns, loss, sizing issues, or other circumstances beyond the Rental Provider's reasonable control.
When necessary, the Rental Provider may offer a comparable substitute, alternative costume, credit, or refund, as appropriate under the circumstances and any separately posted refund policy.
20 Indemnification
To the fullest extent permitted by applicable law, the Renter agrees to indemnify and hold harmless the Rental Provider and event organizers from third-party claims, losses, damages, or reasonable expenses arising directly from the Renter's misuse of Rental Items, violation of these Terms & Conditions, or negligent or intentional acts.
21 Arizona Law and Severability
This agreement shall be governed by the laws of the State of Arizona.
If any provision is determined to be invalid, illegal, or unenforceable, the remaining provisions shall remain in effect to the fullest extent permitted by law.
22 Entire Agreement and Electronic Acceptance
These Terms & Conditions constitute the agreement between the Renter and Rental Provider concerning the Rental Items, except for any additional policies or terms expressly incorporated into the reservation.
Electronic acceptance, including checking a required checkbox during online checkout, constitutes the Renter's acknowledgment and acceptance of these Terms & Conditions to the extent permitted by applicable law.
